Terms of Service

1. Acceptance of Terms

By accessing or using GrowSmart (“the Service”), operated at growsmart.kids, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

GrowSmart is an AI-powered platform designed for parents of children ages 2–8. It provides tools that support holistic child development — including creativity, curiosity, emotional intelligence, and communication — aligned with IB PYP school philosophy. The Service includes free and paid subscription tiers.

3. Eligibility

  • You must be at least 18 years old to create an account and use the Service.
  • The Service is intended for use by parents and guardians. Children should only interact with GrowSmart tools under parental supervision.
  • By creating an account, you represent that the information you provide is accurate and complete.

4. Accounts

  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions and Payments

  • GrowSmart offers free and paid plans. Features and usage limits vary by plan.
  • Paid subscriptions are billed monthly. Prices are listed on our pricing page and may change with notice.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge for refund requests.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorised access to any part of the Service or its systems.
  • Use the AI tools to generate harmful, abusive, or inappropriate content.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Resell, redistribute, or commercially exploit the Service without written permission.
  • Use automated scripts or bots to access the Service beyond normal usage.

7. AI-Generated Content

  • GrowSmart uses AI (powered by Anthropic’s Claude) to generate content including stories, activities, insights, and suggestions.
  • AI-generated content is provided for informational and educational purposes. It is not a substitute for professional advice (medical, psychological, educational, or otherwise).
  • While we strive for accuracy, AI outputs may occasionally contain errors. You should exercise your own judgement when acting on AI-generated suggestions.
  • You retain ownership of any content you create or input into the Service.

8. Third-Party Integrations

  • The Service may integrate with third-party services such as Google (for authentication and Gmail access).
  • Your use of third-party services is subject to their respective terms and privacy policies.
  • We are not responsible for the availability or practices of third-party services.

9. Intellectual Property

  • The Service, including its design, code, branding, and original content, is owned by GrowSmart and protected by intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.
  • Content you generate using our tools (stories, artwork descriptions, etc.) belongs to you.

10. Limitation of Liability

To the maximum extent permitted by law, GrowSmart and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. The Service is provided “as is” without warranties of any kind, express or implied.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by contacting us.

12. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
